EMCO Administrative Services S.C. (the "Company" or “Evolve”), commercially known as "Evolve", with address in Torre Chapultepec Uno - 16th Floor, Suite 1607 - Paseo de la Reforma 509, Col. Cuauhtémoc, CP. 06500, Mexico City, protects the information and personal data (the "Personal Data") provided by its customers and potential customers.

Evolve is responsible for the use and protection of Personal Data and the processing thereof whenever they are collected through the www.evolvemanagement.mx  website (the “Site"), or through printed media, emails with the domain "evolvemanagement.mx" or, by telephone ("Other Means").

Accordingly, we make available this Privacy Notice, to comply with the Federal Law on the Protection of Personal Data in Possession of Individuals (the “Law"). The objective is to make your knowledge the processing, the purpose, and where appropriate, with whom we share your Personal Data.

What do we use your Personal Data for?

Evolve requests and/or collects through the Site and Other Means the Personal Data of customers and potential customers in order for the Company to be able to provide the service it usually and professionally provides satisfactorily.

The processing of Personal Data consists of primary and secondary purposes. Each of them is then listed.

Main purposes of the processing of your Personal Data:

  • Verify and confirm your identity.

  • Verify and confirm your financial situation.

  • Design and manage the services or products you request or contract with Evolve.

  • Create a record, modify it, and store it.

  • Customize the service.

  • Develop financial runs that allow you to offer the right product.

  • Perform statistics to grow your business.

  • Analyze the financial situation and business relationships of your business.

Secondary purposes of the processing of your Personal Data:

  • Send the user information and/or documentation related to the service provided by the Company.

  • Send to the user advertising, promotions and/or communications related to the service provided by the Company.

  • Marketing.

If the data indicated is not available, the Company would not be able to provide the service or provide the product that the user has requested or, which it is interested in contracting with Evolve.

To whom and for what do we transfer your Personal Data?

The Company may disclose, disclose and/or transfer in and out of the country the Personal Data provided by users to a third party, including without limitation, to its affiliated, subsidiary, and/or related companies, as well as to suppliers, sponsors, advertisers, contractors and/or business partners in order to improve, modify and/or personalize the service provided to the user. Third parties who receive information related to users' Personal Data are required to comply with this Privacy Notice, as well as the Site Terms and Conditions and applicable law in the United Mexican States (Mexico).

The owner of the Personal Data provided through the Site, accepts its transfer in the terms described herein. The Company and/or any third party that intervenes in any phase of the processing of Personal Data will keep confidentiality with respect to them when they have such character, in accordance with the legal provisions applicable in Mexico.

What means are there to limit the use or disclosure of your Personal Data?

The Company has physical, technical, and administrative security measures for the protection of Personal Data provided by users. If the user wishes to stop receiving promotional messages via e-mail and/or in print and/or telephone form by the Company, he/she can request it through contact@evolvemanagement.mx, without prejudice to the electronic mechanisms that for this purpose are established, where appropriate, in the messages that the user receives.

How to Access, Rectify, Cancel or Object to the processing of your personal data?

The exercise of the rights of Access, Rectification, Cancellation or Opposition of Personal Data and Revocation of consent made by users, must be made upon request to the Company and contain at least the following:

  • The name of the holder, address, and email address to communicate the response to your request.

  • Documents proving the identity or, where applicable, the legal representation of the holder.

  • A clear and precise description of the Personal Data in respect of which it is sought to exercise any of the aforementioned rights (in the case of rectification the modifications to be made and provide the documentation that supports your request) must be indicated).

  • Any other element or document that facilitates the location of Personal Data.

The Company shall respond to the request of users within 5 (five) working days from the date on which it receives the corresponding request, through the email provided for this purpose.

Exclusion of Site Liability

The Site may contain hyperlinks or hypertext "links", banners, buttons, and/or search tools on the "World Wide Web" that when used by users’ transport to other portals or Internet sites that may be owned by third parties. The Personal Data that users are provided through these portals or Internet sites are not covered by this Privacy Notice and their processing is not the responsibility of the Company.

Users may find within the Site: pages, promotions, microsites, virtual stores, surveys, work bags and other services that may be shared with third parties and may request your Personal Data("Third Party Sites"). Any information relating to personal data provided through the Third-Party Sites will be subject to the respective privacy notices contained in each of them, unless otherwise stated by the Company.

"Cookies" and "Web Beacons"

In order to improve the experience of its users on the Site, the Company may use “cookies". For purposes of this Privacy Notice  "cookies"  will be identified as the text files of information that a website transfers to the hard drive of the computer of users in order to store certain records and preferences.

The Company may use "cookies"  to better understand the interaction of users with the Site and the services provided. The Site may allow advertising or third-party features that send  "cookies"  to users' computers or devices. By using  "cookies”, users are not personally identified, but only their computers and/or devices.

For its part, "web beacons “are images inserted into an Internet page or email that can be used to monitor the behavior of a visitor: storing information about the USER's IP address, duration of interaction time on the Site and the type of browser used, among others.

Processing of Sensitive Personal Data

According to the Law, Sensitive Personal Data corresponds to all data that may affect the most intimate sphere of its owner or whose misuse may create discrimination or entail a serious risk to it: racial or ethnic origin, present, and future health status; genetic information, religious, philosophical and moral beliefs, trade union membership, political opinions, sexual preference.

At Evolve we do not collect or process any Sensitive Personal Data from our customers or potential customers.

Consent

The entry and/or registration through the Site and/or Other Means, implies the full and unreserved consent of users for the processing of their Personal Data in accordance with this Privacy Notice.

Modifications to the Privacy Notice

The Company reserves the right to modify at any time the content of this Privacy Notice. Any changes herein will be informed to its users through the site www.evolvemanagement.mx .
